Consumer Health Data Policy

Scope

This policy explains how Fourth handles consumer health data. It supplements our Privacy Policy, and terms defined there have the same meaning here.

It is written to meet Washington's My Health My Data Act, Nevada's consumer health data law (SB 370), Connecticut's consumer health data protections, and similar state laws. We apply these protections to every Fourth user, wherever they live.

Fourth is operated by The Mother Network Inc., 212 King Street West, 6th Floor, Toronto, Ontario, Canada M5H 1K5.

1. The consumer health data we collect

"Consumer health data" is personal information linked or reasonably linkable to you that identifies your past, present or future physical or mental health. At Fourth, this includes:

We do not infer health information about you from other data, and we do not collect precise location.

2. Where it comes from

  • From you, when you create a registry, set up cash funds, or use the recovery tracker.
  • Automatically, when you use Fourth, through cookies and analytics tools, only with your consent where required. Analytics never run on tracker pages. See our Cookie Policy.

3. Why we collect and use it

We collect and use consumer health data only to:

  1. provide the Services you ask for, including your registry, cash funds, recovery content and tracker;
  2. provide customer support when you ask for it;
  3. keep Fourth secure and prevent fraud;
  4. comply with the law.

We do not use consumer health data for advertising, marketing, profiling, research or AI training.

4. Consent

We collect consumer health data only when it is necessary to provide a service you have asked for, or with your consent. Before you first use the recovery tracker, we ask for your express consent in a separate step. You can withdraw consent at any time by deleting your tracker entries or closing your account.

We do not use geofencing around health care facilities, or anywhere else.

5. Who we share it with

We never sell consumer health data. We will not ask you for the signed authorization the law requires for a sale, because we do not sell.

We disclose consumer health data only to the processors below. Each acts on our instructions under a written contract.

We also disclose consumer health data:

  • at your direction, such as when you share your registry with guests or export your tracker;
  • when the law requires it, such as a valid court order. We will not voluntarily give health information to law enforcement, and we will tell you about a request unless the law prohibits us.

We do not share consumer health data with affiliates, including The Mother Network platform.

6. Your rights

You have the right to:

  1. confirm whether we collect, share or sell your consumer health data;
  2. access your consumer health data, including a list of every third party and affiliate we have shared it with and how to contact them;
  3. withdraw your consent to our collection or sharing of it;
  4. have it deleted. We delete it from our systems and tell our processors to delete it too. Copies in backups are overwritten within 90 days.

We will not treat you differently for using these rights, and they are free.

How to make a request. Email legal@fourthregistry.com with the subject "Health Data Request," or use the export and delete tools in your account settings. We will verify your identity through your account email. We respond within 45 days. If we need more time, we may extend this once by up to 45 days and will tell you why.

7. Appeals

If we decline your request, you can appeal by emailing legal@fourthregistry.com with the subject "Health Data Appeal." We will respond in writing within 45 days and explain our decision.

If we materially change this policy, we will notify you at least 30 days before the change takes effect. We will ask for your consent before collecting or sharing consumer health data for a new purpose.
